The Legislature has "run afoul" of the Florida Constitution by requiring counties to fund the offices of the Criminal Conflict and Civil Regional Counsel, a Second Judicial Circuit judge has ruled. "Plaintiffs have met their burden and have established, as a matter of law, that Section 19 of Chapter 200762, Laws of Florida, in its attempt to shift the funding requirements for Criminal Conflict and Civil Regional Counsel from the state to the counties, is unconstitutional and not binding upon them because it violates Article V, Section 14, Florida Constitution," Second Circuit Judge John Cooper wrote in a December 18 final summary judgment in two consolidated cases involving 26 counties (cases 2008-CA-2448 and 2008-CA-2475 filed in Leon County Court).
